JUDGMENT : 1. The petitioner earlier filed a writ petition before this Court in WP.No.23895 of 2012 challenging the order dated 27.8.2012 on the file of the second respondent. The writ petition was disposed of by this Court with a direction to the second respondent to complete the adjudication process, as expeditiously as possible. 2. It is the grievance of the petitioner that not withstanding the order, earnest efforts were not taken by the respondents to adjudicate the matter and refund the amount. The petitioner now wanted a direction to the respondents to entertain his refund application and refund the amount due to him. 3. I have heard the learned counsel for the petitioner and the learned Government Advocate for the respondents. 4. The learned Government Advocate, on instructions, submitted that the second respondent has not adjudicated the matter so far and that was the reason for failure to consider the application. 5. The second respondent is directed to comply with the order dated 31.8.2012 passed by this Court in WP.No.23895 of 2012 by adjudicating the matter. Such exercise shall be completed within a period of four weeks from the date of receipt of a copy of this order. 6. While adjudicating the matter, the second respondent should also indicate as to whether any amount is liable to be refunded to the petitioner. Incase, the order contain a finding that the petitioner is entitled to get refund, it should be paid within a period of two weeks from the date of passing the order. 7. The writ petition is allowed to the extent indicated above. No costs. It is needless to state that opportunity of hearing should be given to the petitioner during the course of adjudication.
