Judgment : The Court: The petitioner in this W P under art.226 of the Constitution of India dated May 8, 2013 is seeking the following principal relief:- “a) A writ or writs in the nature of Mandamus do issue directing the concern Respondent Authorities, their men, agents, and subordinate officers to forthwith release and pay Leave Encashment/Leave Wages of the petitioner;” The petitioner retired from the services of CDLB on September 22, 2005. Advocate for the respondents has submitted that because of financial crisis the Board could not pay the petitioner all his retirement benefits, and that the benefits will be paid within a few days. It is just inconceivable that the petitioner retiring as back as September 22, 2005 is yet to receive all his retirement benefits which were payable on September 22, 2005 itself. The respondents coming up with the plea of financial crisis have not come up with a case that they are not paying salaries and allowances regularly to their employees and officers in employment. Withholding of retirement benefits that a retired person needs the most is a violation of human rights. The employees and officers regularly getting their salaries and allowances never thought for a moment to what distress they led the petitioner who was to survive on his retirement benefits. For these reasons, I dispose of the W P ordering as follows. Within a fortnight from the date this order is served the respondents shall pay the petitioner all his unpaid retirement benefits with 8% p.a. interest and five thousand rupees costs.
