Judgment : 1. This court passed an order on 16.04.2013 in W.P.No.10143 of 2013 and a subsequent order on 29.04.2013 appointing Election Officer to conduct the election to the Managing Committee of the Association of Surgeons of India. As per the schedule, the election process would commence from 06th May and it would end by declaring the results today, ie., 06th August 2013. 2. According to the petitioner, the respondents 5 to 8 are contemplating to disturb the very election process and they would be interfere with the process of declaration of results. The petitioner, therefore, wanted the District Registrar, Chennai to ensure that the results are declared without any disturbance. 3. I have heard the learned senior counsel for the petitioner and the learned counsel appearing on behalf of the fourth respondent. 4. The election process was commenced pursuant to the order passed by this court dated 16.04.2013 and the subsequent order dated 29.04.2013 in W.P.No.10143 of 2013. This court has appointed Thiru.R.Santhanam, I.A.S., (Retd.) Former Member, Central Administrative Tribunal, Hyderabad as the Election Officer and under the supervision of the said Election Officer, the election process commenced and the same would be over today by declaring the results. 5. The learned senior counsel for the petitioner and the learned counsel for the fourth respondent jointly submitted that the elections were conducted in a smooth manner and their only apprehension is about the declaration of results. 6. There is no question of interfering in the election process commenced by the fourth respondent on the strength of the orders passed by this court. 7. The Election Officer is directed to announce the results as scheduled. If there is any disturbance either for declaration of results or for entrusting the administration with the newly formed Association, it is open to him to submit an application before the Assistant Commissioner of Police, Triplicane for police protection and in the event of making any such application necessarily appropriate protection should be given by the police. 8. Issue notice to the respondents 5 to 8 returnable by 26.08.2013. Private Notice is also permitted.
