Judgment : The Court: The petitioner in this WP under art.226 of the Constitution of India dated April 16, 2013 is aggrieved by the fact that the authority whose decision was served on him by the Chief Executive Officer of Howrah Improvement Trust (in short HIT) has not considered his representation dated March 11, 2013 (W P p.51) for reconsideration of the decision mentioned in the letter of the Chief Executive Officer dated December 21, 2012 (W P p.45). Advocate for the petitioner has submitted that in similar cases evictees such as the petitioner were allotted shop on the terms and conditions mentioned in the petitioner’s representation dated March 11, 2013. I think it will be appropriate to dispose of the WP directing the authority concerned to examine the petitioner’s grievances and give the final decision. For these reasons, I dispose of the W P ordering as follows. The authority whose decision the Chief Executive Officer of HIT made known by his letter dated December 21, 2012 shall examine the petitioner’s grievances stated in his representation dated March 11, 2013 and give the final decision dealing with the issue of allotment of shop to the petitioner. Compliance within six weeks from the date this order is served. No costs.
