Judgment : 1. The present civil revision petition is filed seeking for early disposal of E.A.No.232 of 2012 in E.P.No.111 of 2008 in O.S.No.555 of 2003 on the file of the District Munsif Court, Pollachi. The said application was filed by the petitioner seeking to set aside the exparte order passed in E.P.No.111 of 2008 on 11.04.2012. 2. Heard the learned counsel for the petitioner as well as the respondents. 3. Learned counsel for the respondents submits that the petitioner's application in E.A.No.232 of 2012 has not been filed in time and therefore, the same is not maintainable. 4. As the limited prayer before this Court is only for a direction to dispose of the said E.A., I am not expressing any view on merits and contentions of the rival parties except by directing the court below to dispose of E.A.No.232 of 2012 in E.P.No.111 of 2008 in O.S.No.555 of 2003 on merits and in accordance with law within a period of 30 days from the date of receipt of a copy of this order. Needless to say that the respondents herein are at liberty to raise all their contentions and objections before the court below while resisting the said application. However, as I am directing the court below to dispose of the said E.A., the Executing court shall not pass orders in the E.P. in the meantime. 5. With the above directions, the civil revision petition is disposed of. No costs. The connected miscellaneous petition is closed.
