Judgment :- 1. The prayer in this writ petition is as follows:- “It is therefore prayed that this Hon'ble Court may be pleased to issue a WRIT OF MANDAMUS, directing the respondents to consider and pass orders on the written representation, dated 1.4.2008 made by the petitioner for payment of terminal and service benefits of his deceased father namely Azhagar, served as Sweeper in the 3rd respondent Panchayat within the time that may be stipulated by this Hon'ble Court and pass any other order or direction as this Hon'ble Court may deem fit and proper in the circumstances of the case and thus render justice.” 2. The case of the petitioner is that his father was working as 'Sweeper' at the third respondent Panchayat for more than 25 years and died on 24.12.2007 due to illness. Immediately after the death of his father, he made a representation to the respondents on 07.01.2008 and sought for release of insurance benefits and other terminal benefits. As there was no order passed on the said representation, the petitioner made further representation on 01.04.2008. As the said representation has not been considered, the present writ petition is filed before this court. 3. A counter affidavit is filed, in which it is stated that no such representation, dated 01.04.2008 was received by the second respondent office and therefore, they are not in a position to take action to give direction to the Panchayat President. 4. As it is denied by the respondents specifically that no representation was received from the petitioner, I only direct the petitioner to make a fresh representation to the respondents within a period of two weeks from the date of receipt of a copy of this order. If any such representation is made, the respondents shall consider the same and pass orders on merits and in accordance with law within a period of eight weeks thereafter. 5. The writ petition is disposed of accordingly. No costs.
