Judgment : The Court: None to press the WP. The petitioner retired from the services of Eastern Coalfields Limited on January 1, 2008. He was paid gratuity. According to him, he was entitled to a higher amount. Mr. Banerjee appearing for the respondents has submitted that gratuity was payable according to the provisions of the Payment of Gratuity Act, 1972. The WP is dismissed for non-appearance of the petitioner. Nothing herein shall prevent the petitioner from approaching the controlling authority under the Payment of Gratuity Act, 1972, if he is otherwise entitled to do that. No costs.
