Judgment : 1. The petitioner was upgraded as Head Constable w.e.f. 22.7.2000 from Grade I Police Constable. He was further promoted as Special Sub-Inspector of Police w.e.f. 1.8.2011. But, he is still paid the pay of Grade I Police Constable is the grievance of the petitioner. 2. According to the petitioner, he is not paid the pay of Head Constable as well as the pay of Special Sub-Inspector of Police. 3. The petitioner made a representation dated 15.6.2012 in this regard to the respondents. Since no order is passed, the petitioner has filed this Writ Petition seeking a direction to the respondents to dispose of his representation dated 15.6.2012 so as to fix his salary in the cadre of Head Constable as well as in the cadre of Special Sub-Inspector of Police. 4. Heard the learned Senior Counsel appearing for the petitioner. 5. The learned Senior Counsel for the petitioner made his submissions based on the averments in the affidavit filed in support of the Writ Petition. He has taken me through various proceedings based on which the petitioner was upgraded as Head Constable and thereafter, as Special Sub-Inspector of Police. 6. As rightly contended by the learned Senior Counsel for the petitioner, on upgradation to the post of Head Constable and subsequently, as Special Sub-Inspector of Police, the petitioner should have been paid the salary to the post for which he was upgraded. It is not known as to why the authorities still continue to pay the salary of Grade I Police Constable while he was upgraded as Head Constable in 2000 and subsequently as Special Sub-Inspector of Police in 2011. 7. In the circumstances, the 2nd respondent is directed to pass orders on the representation of the petitioner dated 15.6.2012 on merits and in accordance with law, within a period of two weeks from the date of receipt of a copy of this Order and also take suitable action against the person for not paying the appropriate salary even after upgradation,if salary for the upgraded posts was not given as averred by the petitioner. 8. The Writ Petition is disposed of in the above terms. No costs.
