JUDGMENT 1. This petition has been filed seeking to enlarge the petitioner on bail in respect of Crime No.04/2013 on the file of the respondent police. 2. This criminal original petition was referred for mediation to the Tamil Nadu Mediation and Conciliation Centre, High Court of Madras, by the order of this Court, dated 8.4.2013. 3. A communication, dated 10.7.2013, of the Tamil Nadu Mediation and Conciliation Centre, High Court of Madras, enclosing a copy of its Mediation Report, dated 12.6.2013, has been received, and in the said Mediation Report, it is stated as follows:- "Parties appeared before the Centre along with their Counsel. Parties arrived at an amicable settlement as per the terms in the Mediation Agreement enclosed herewith. Hence, the matter is sent back to the Hon'ble Court." 4. As the parties have arrived at a settlement in terms of the Mediation Agreement, dated 12.6.2013, this petition is listed for passing orders in terms of the said Mediation Agreement. 5. The Mediation Agreement, dated 12.6.2013, signed by the parties and the counsel appearing for the petitioner, reads as follows:- "Both sides, out of their own volition and without any pressure or coercion from any side have agreed as follows: (a) The Defacto Complainant / A. Asha agrees to withdraw the complaint as she has her sister to be married and confirm that she is agreeing to withdraw the complaint without any threat, compulsion or undue influence. (b) The Defacto Complainant / A. Asha only is insisting that the Petitioner / S.Jayakaran, and his family members should not in any manner whatsoever interfere or cause interference through others in the matter of the Defacto Complainant / A.Asha. The maternal uncle of Petitioner / S.Jayakaran assures that there will be no interference. (c) The Defacto Complainant / A.Asha also agrees not to interfere in the matter of Petitioner / S.Jayakaran or cause interference in any manner whatsoever. (d) The said Petitioner / S.Jayakaran assures that neither himself nor his family members particularly his mother Mrs. Gnanamani, will not interfere in any matter concerning the Defacto Complainant / A.Asha and confirm she will not cause any interference to the Defacto Complainant / A.Asha through anyone. S.Murali the maternal uncle of Petitioner / S.Jayakaran assures the same and both agree that on the violation of the agreement suitable action can be taken against them. Gnanamani, will not interfere in any matter concerning the Defacto Complainant / A.Asha and confirm she will not cause any interference to the Defacto Complainant / A.Asha through anyone. S.Murali the maternal uncle of Petitioner / S.Jayakaran assures the same and both agree that on the violation of the agreement suitable action can be taken against them. (e) On the above said terms the Defacto Complainant / A.Asha hereby agrees to withdraw the complaint in Crime No.4/2013 on the file of the Inspector of Police, All Women Police Station, Ranipet, Vellore District given against S.Jayakaran." 6. In terms of the settlement arrived at between the parties, which is recorded under the Mediation Agreement, dated 12.6.2013, and in terms of the Mediation Report, dated 12.6.2013, before the Tamil Nadu Mediation and Conciliation Centre, High Court of Madras, this petition is disposed of, recording the terms of the Mediation Agreement, dated 12.6.2013. The terms of the Mediation Agreement, dated 12.6.2013 and the Mediation Report, dated 12.6.2013, of the Mediation Centre, shall form part of the order.
