Judgment : 1. The present civil revision petition is filed against the order of arrest made in the execution of the decree passed by the court below to recover Rs.82,340.50/-. The petitioner/judgment debtor has not preferred any appeal against the judgment and decree made by the trial court. Even in the execution proceedings, he has stated that he is willing to pay the decretal amount by a monthly installment, which the court below has rejected and ordered arrest. 2. By an order dated 13.06.2013, this Court directed the petitioner to pay a sum of Rs.15,000/- to the respondent within a period of four weeks. It is now stated by the petitioner that they have taken a Demand Draft for the said sum and tendered the same to the counsel for the respondent. Learned counsel for the respondent also acknowledged the receipt of the same. Thus, the balance amount payable is thus Rs.67,340.50/-. 3. Considering the submission made by the learned counsel for the petitioner that the petitioner will not be in a position to pay the balance amount in bulk sum as he is not having enough funds, this Court is of the view that it would meet the ends of justice if the balance amount of Rs.67,340.50 (Rupees Sixty seven thousand three hundred and forty and fifty paise only) is directed to be paid in three equal monthly installments commencing from 16th September 2013. Accordingly, it is ordered that (i) the first installment of Rs.22,445/-is to be paid by the petitioner to the respondent on or before 15.10.2013; (ii) the second installment of Rs.22,445/-is tobe paid on or before 14.11.2013 and (iii) the third installment of Rs.22,450.50/-is tobe paid on or before 13.12.2013. If the petitioner defaults in paying anyone of the installments, the respondent is at liberty to move the execution court for seeking the arrest of the petitioner by filing appropriate application. Accordingly, the civil revision petition is disposed of. No costs. The connected miscellaneous petition is closed.
