JUDGMENT : M.M. Sundresh, J. 1. Heard Mr.V.P.Raman, learned counsel for the appellant and Mr.R.Muthukumarasamy, learned Senior Counsel for the 1st respondent-caveator. 2. This Writ Appeal has been preferred by the appellant, who was the 2nd respondent in the writ petition, challenging the order of the learned single Judge, in and by which, the order impugned in the writ petition was set aside, with a direction to the appellant to reconsider the matter afresh, after affording sufficient opportunity to the 1st respondent. 3. We have gone through the order passed by the learned single Judge. We do not find any error in the order passed. What has been passed is only an order of remittal to reconsider the entire issues. The appellant cannot be said to be aggrieved against the said order. As rightly held by the learned single Judge, the order impugned has got civil consequences and the 1st respondent has not been heard before passing the said order. We also find that the learned single Judge has not expressed any opinion on the merits of the case. In such view of the matter, we do not find any ground to entertain the writ appeal. Hence, the Writ Appeal is dismissed. No costs. M.P.No.1 of 2013 is closed.
