Judgment : 1. This writ petition was filed challenging the award of the Labour Court made in I.D.No.25 of 1994 dated 12.02.2002. Through the impugned award, the Labour Court directed reinstatement of the second respondent herein with backwages. 2. It is represented by the learned counsel on either side that during the pendency of the writ petition, the second respondent was reinstated into service on a specific undertaking given by him that he will not claim backwages. 3. It is also submitted that the petitioner after such reinstatement, served the petitioner Corporation and also retired from service on 31.07.2013. Now, it is admitted by the learned counsel for the second respondent that he was reinstated into service, based on his undertaking given that he will not claim any backwages. 4. Therefore, nothing survives in this writ petition for further adjudication and the writ petition is dismissed as become infructuous. It is made clear that dismissal of this writ petition will not entitle the second respondent to claim backwages in view of his undertaking given already. In respect of all other service benefits, it is open to the second respondent to make such legally sustainable claim and it is open to the petitioner to consider the same in accordance with law. No costs.
