Arvind Kumar Tripathi,J:- Heard learned counsel for the petitioner, learned Standing Counsel and perused the record. 2. By means of present writ petition the prayer is to issue writ of mandamus commanding the respondent no.2 to realised the amount of Rs.1,39,372.25 shown in the recovery certificates dated 16.4.2012, from the respondent no.3 to ensure its payment to the petitioner within stipulated period along-with 18% interest. 3. Case of the petitioner is that husband of the petitioner was initially appointed as Mali during April, 1994, on daily wages, who continued upto 30.6.1999 and completed more than 240 days in each and every year. However, when there was demand of regularisation of service then without giving any notice and proper opportunity he was removed from service, thereafter, matter was referred to the labour court (1), Kanpur and the award was passed in favour of petitioner on 28.10.2009 in Adjudication Case No.181 of 2008. The aforesaid award has become final and in pursuance of the award neither husband of the petitioner has been reinstated nor back wages has been paid though the review application was also dismissed on 10.10.2011. The application was moved under section 6 H(1) of the U.P. Industrial Dispute, 1947 for execution of the order. In the meantime, husband of the petitioner died on 14.8.2012 though the recovery certificate was issued on 16.4.2012, however, the amount has not been recovered as yet. 4. Considered the submission. In view of the fact, respondent no.3 is expected to pay the amount within reasonable period as mentioned in the recovery certificate and respondent no.2 will ensure recovery and payment of the amount within reasonable period, preferably within three months after furnishing certified copy of this order. Accordingly, present writ petition is finally disposed off. ________________
