SATYA FOOT MEHROTRA, ZAKI ULLAH KHAN

body2013
Hon'ble Zaki Ullah Khan,J.:— Heard Shri Brij Raj Singh, learned counsel for the petitioner, the learned Standing Counsel appearing for the respondent nos. 1, 2, 3 and 5, and Shri H.R. Mishra, learned Senior Counsel assisted by Shri Sunil Kumar Yadav, learned counsel for the respondent no.4. The present Writ Petition has been filed by the petitioner under Article 226 of the Constitution of India, inter-alia, praying for quashing the Final Voter List issued in respect of the election of the District Cooperative Bank Limited, Firozabad. From a perusal of the Writ Petition and Annexures thereto, it is evident that the election process has already started and the elections in respect of the District Cooperative Bank Limited, Firozabad are scheduled to take place as per the election programme, copy whereof has been filed as Annexure 5 to the Writ Petition. As the election process has already started, we are of the view that it will not be appropriate for this Court to exercise its Writ Jurisdiction under Article 226 of the Constitution of India so as to hinder the on-going election process. It will be open to the petitioner to pursue such remedy as may be available to him under law before appropriate Forum, after the elections are over, for seeking appropriate reliefs for redressal of his alleged grievances as raised in the present Writ Petition. In view of the above, the Writ Petition is liable to be dismissed, and the same is accordingly dismissed subject to the observations made above. _____________
