JUDGMENT : 1. The prayer sought for in this writ petition is seeking for a direction to the respondents 1 to 10 to implement the order of the fifth respondent dated 26.7.2004 to conduct joint festival by both the factions of community in the Thenpair village. 2. Perusal of the proceedings dated 26.7.2004 issued by the fifth respondent would show that the festival, which was sought to be conducted by both the factions, was to be held on 26.7.2004. Thus, the petitioner has filed the present writ petition to issue a writ of Mandamus, as stated above, for conducting the Adi month Festival for the year 2005. 3. The writ petition was admitted and is pending now for the past eight years. As the prayer in this writ petition is only for conducting a joint festival for the particular period, I am of the view that such a prayer has become infructuous by taking note of the fact that already eight years have lapsed in the meantime. Therefore, without prejudice to the contentions of the rival parties in respect of the festival to be conducted at the village in future, the writ petition is closed as infructuous, however, by giving liberty to the petitioner and the other contesting private respondent to approach the authorities for seeking appropriate relief, if it is so warranted even at the present stage. No costs. Connected W.P.M.P.No.23945 of 2005 is closed.
