Judgment : 1. The above writ petition is filed seeking for a writ of Mandamus directing the second respondent to stop the illegal stone quarrying at survey No.182, Erumaiyur village, Sriperumbudur Taluk, Kancheepuram District. 2. The grievance of the petitioner is as against the third respondent, who is alleged to have been quarrying illegally. Therefore, the petitioner sought a direction to the second respondent to stop the same. In effect, the relief sought in this writ petition directly affecting the interest of the third respondent. However, as against the third respondent, the writ petition came to be dismissed already on 21.8.2002, as batta has not been paid by the petitioner. Till date, the said order has not been restored as against the third respondent. Consequently, I am of the view that nothing survives in the writ petition further to be adjudicated upon, in view of the fact that the writ petition has already been dismissed as against the third respondent. Considering the above facts and circumstances of the case, the writ petition is dismissed as against the respondents 1 and 2 also. No costs. Connected W.P.M.P.No.24378 of 2005 and W.V.M.P.No.2441 of 2005 are closed.
