JUDGMENT Paramjit Singh Patwalia, J. 1. Present petition has been filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the petitioners in a case arising from FIR No. 679 dated 12.11.2011, registered at Police Station Jhajjar, under Sections 307/302/34 of the Indian Penal Code. Learned counsel for the petitioners stages that he does not press the instant petition on behalf of petitioner Devender @ Badal petitioner No. 1. 2. Dismissed as withdrawn qua petitioner Devender @ Badal. 3. Learned counsel for petitioners states that petitioner No. 2 is a lady and none of the witnesses has supported the case of prosecution and they have been declared hostile. Learned counsel further states that petitioner No. 2 is behind bars since 30.11.2011. 4. All these facts have not been denied by the learned State counsel. 5. Taking into consideration the facts and circumstances of the case and the fact that trial is not likely to be concluded in near future, the petitioner can be granted concession of bail. Without expressing any opinion on merits of the case, petitioner No. 2 is ordered to be released on bail, on her furnishing bail bonds/surety bonds, to the satisfaction of trial Court/Duty Magistrate, Jhajjar. Disposed of.
