Judgment 1. The prayer in this writ petition is seeking for a mandamus directing the respondent to amend the petitioner's date of birth in the passport bearing PP No.E763884 as 31.07.1961 instead of 31.07.1966. 2. The case of the petitioner is as follows: The petitioner is a permanent resident of Chennai and his date of birth is 31.07.1961, as supported by the Birth Certificate issued by the Corporation of Chennai. In the year 1990, the petitioner applied for passport and on 05.12.1980, a passport bearing No.PP.P.883605 was issued by showing the petitioner's date of birth as 31.07.1961. The said passport was subsequently renewed on 26.11.1985, by giving a new passport in PPW No.757245. There also, the petitioner's date of birth was correctly shown as 31.07.1961. Further renewal was applied and a renewed passport was given in PPQ739363, valid for a period of ten years. But due to typographical mistake, the date of birth of the petitioner was shown as 31.07.1966. The said passport also expired and when the petitioner sought for further renewal, he brought to the knowledge of the authorities about the wrong mentioning of the date of birth. Inspite of the same, a fresh passport was issued in PP No.E5763884 with effect from 20.06.2003 for a period of ten years by showing the date of birth once again wrongly as 31.07.1966 without amending the same. Therefore, the present writ petition is filed before this Court. 3. The writ petition was admitted on 15.07.2005 and rule nisi was issued. 4. Heard the learned counsels appearing on either side. 5. The only grievance of the petitioner is that his date of birth was wrongly shown in the passport as 31.07.1966 instead of 31.07.1961. It is stated by the petitioner that the said mistake was brought to the knowledge of the respondent when renewal was sought for in the year 2003. But however, without rectifying the mistake and amending the date of birth, the respondent issued the passport by wrongly showing the date of birth as 31.07.1966. If that is the grievance of the petitioner, then it is for the respondent to consider the same and pass appropriate orders for rectifying the mistake after proper verification of the material documents in support of such claim made by the petitioner. It appears that the passport issued to the petitioner also expired on 19.06.2013. The petitioner's counsel is not in a position to state as to whether any passport renewal application is filed. If any such renewal application is filed, it is for the respondent to consider the claim of the petitioner for correcting his date of birth and pass an order on the same accordingly. 6. Therefore, the writ petition is disposed of with a direction to the respondent to pass appropriate orders on the petitioner's claim for correcting his date of birth after proper verification of the supporting documents from the petitioner. The respondent shall pass such an order within a period of eight weeks from the date of receipt of a copy of this order. No costs. The connected miscellaneous petition is closed.
