ORDER 1. This is 5th application for grant of bail under section 439 CrPC by applicant Rahul @ Amit, who is in custody since 5.12.2011, in connection with Crime No. 388/2011, registered at Police Station Depalpur, district Indore for an offence under sections 392, 397 and 458 of IPC and section 25/27 of the Arms Act, 1959. 2. As per prosecution story, looted motorcycle bearing registration No. MP-10/MV-2315 has been seized from the possession of the present applicant. During interrogation one more motorcycle has been seized from his possession. His 2nd, 3rd and 4th applications were dismissed. 3. Learned counsel for the applicant submits that apart from this two more criminal cases were registered against the applicant and in both the cases he has been released on bail. He is in custody and till today he has completed 1 year and 4 months and looking to the period of custody so also the fact that no further interrogation is required, it is prayed that this repeat application be allowed and the applicant be released on bail. 4. Learned Panel Lawyer opposed the prayer and prayed for its rejection. 5. On due consideration of the aforesaid facts and circumstance of the case and material evidence available in the case diary, without expressing any opinion on the merits of the case, this repeat application is allowed and it is directed that the applicant be released on bail subject to his furnishing a personal bond to the tune of Rs. 40,000/- with one surety of like amount to the satisfaction of the concerned JMFC/CJM for his appearance before him of trial Court, as the case may be, on all dates of hearing fixed in this behalf by the Court concerned during trial.
