Judgment : 1. This Civil Revision Petition is filed for early disposal of E.P.No.99 of 2006 in O.S.No.77 of 2005 pending before the Additional Sub-Court, Mayiladuthurai. 2. The petitioner/plaintiff in the suit filed this Civil Revision Petition to direct the Trial court to dispose of the E.P.No.99 of 2006 in O.S.No.77 of 2005 pending before the Additional Sub-Court, Mayiladuthurai. 3. Heard Mr. A. Muthukumar, the learned counsel appearing for the petitioner. 4. No representation on the side of respondents. Eventhough notice to R-2 was duly served, he neither appeared in person nor through his counsel. The learned counsel for first respondent also not appeared. 5. The learned counsel appearing for the petitioner submitted that in E.P.No.99 of 2006 filed on 14.09.2006, no appeal has been preferred and pending as against the decree and judgment passed by the Trial court in the above said O.S. and therefore, prayed for to direct the Trial Court to dispose of the above said E.P. early. 6. This petition is filed on 09.06.2010 and notice ordered on 15.07.2010. Since the respondents' side not appeared in person or through his counsel and in view of the reasons stated in the affidavit filed by the petitioner, this petition has to be allowed and direction should be given as prayed for to the petitioner. 7. In the result, the Additional Sub-Court, Mayiladuthurai is directed to dispose of the E.P.No.99 of 2006 in O.S.No.77 of 2005 within a period of three months from the date of receipt of a copy of this order and this petition is ordered accordingly. No order as to costs.
