ORDER Heard learned counsels representing the parties who are in agreement to get this appeal disposed of at the admission stage itself. 2. This is an appeal preferred against order dated 24.03.2011 passed in Probate Case No. 33/2001 by Additional District Judge, Fast Track Court - 1st at Bhagalpur, granting the probate. 3. The admitted fact of the case is that the proceeding was initiated to get the will said to be executed on 28.04.1992 by one Jagarnath Sah, probated, who died on 8.2.1996 leaving behind two sons and two daughters, but the will is said to be executed in favour of one of the daughter-in-law respondent no. 1. 4. The first point against the impugned order is raised by the learned counsel for the appellant is that probate proceeding is barred under law since Section 137 of the Limitation Act provides three years limitation for bringing into the action, if there is no period prescribed under law. But, in view of decision of Division Bench of this Court in case of Ramanand Thakur vs.Parmanand Thakur reported in AIR 1982 (Patna) 87, wherein it has clearly been held in first paragraph that “……….. so far as the applications for grant of a probate or Letters of Administration are concerned they are not governed by any Article of the Limitation Act……………” 5. Learned counsel for the appellant tried his level best to establish that the will in question was forged and fabricated but to support such submission unfortunately except such assertion made by the contesting parties there is absolutely nothing. There also appears no attempt even made to produce any document containing admitted signature or L.T.I. of the deceased or any of the witnesses who could not be examined only due to their death earlier but their sons or other persons connected, appeared and supported the signatures of their ancestors genuine on the will. 6. In view of the above, in absence of any material shown to indicate any irregularity or illegality committed, finding no reason to interfere in order impugned, this appeal is hereby dismissed. However, there is no order as to cost.
