Judgment :- Jayanta Kumar Biswas, J. The petitioner in this WP under Article 226 of the Constitution of India dated June 19, 2013 is seeking the following principal relief:- “b) A writ in the nature of Habeas Corpus do issue commanding the respondent No.1 to 6 to produce the body of the daughter of the petitioner namely Tania Dey before this Hon’ble Court and be set at liberty.” The first-sixth respondents referred to in prayer (b) of the WP are the State of West Bengal and five police officials of the State; and the seventh respondent is one Sanjit Halder. Advocate for the petitioner has submitted that the police have not taken any step for recovery of the petitioner’s daughter illegally detained by Sanjit. In para.6 of the WP it has been stated that on the basis of the petitioner’s information a case No.52 of 2013 dated March 17, 2013 was registered against Sanjit in Krishnaganj police station in Nadia under ss.363/365 IPC. Advocate for the State has produced the case diary of the criminal case to show that in her s.164 statement the 20-year old daughter of the petitioner clearly stated that Sanjit whom she married did not do any wrong to her. The case diary reveals that after completing investigating the police officer concerned submitted report to the criminal court that no case was made out for sending Sanjit up for trial. There is nothing to show that the petitioner raised any objection to the acceptance of the report by the criminal court. From the above-noted facts it is evident that during pendency of the criminal case instituted alleging that Sanjit had kidnapped the petitioner’s daughter, the petitioner moved this habeas corpus petition, evidently, for asking the investigating officer to recover and produce the girl. There is absolutely no basis to reach a conclusion that Sanjit has been illegally detaining the girl,-an adult. The investigation has revealed that of her own accord, the girl married the boy,- also an adult. In our opinion, this is a totally misconceived habeas corpus petition. For these reasons, we dismiss the WP. No costs.
