Judgment :- A.S. Pachhapure, J. 1. The petitioner has approached this Court seeking bail having been arrested and charge sheeted for the offence punishable under Section 394 IPC. 2. The petitioner is accused No.4 and he as been in custody for the last more than two years. A sum of Rs. 9,000/- was recovered from the petitioner during the investigation. 3. The accused No.3 who was in custody for the period of two years and a sum of Rs. 11,000/- was recovered from him, has been released on bail by this Court in Criminal Petition No. 7594/2012 vide order dated 12.12.2012. Considering the fact that the petitioner is similarly placed, he is entitled to the bail sought for. 4. In the result, the petition is allowed. The petitioner is ordered to be released on bail on executing a personal bond for a sum of Rs.50,000/-with two solvent sureties for the like sum to the satisfaction of the Magistrate Court/Sessions Court with the further following conditions : i) That the petitioner shall mark his attendance before the Vijayanagar Police Station, Mysore City, on every Sunday in between 10.00 to 11.00 a.m. until further orders. (ii) He shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer. (iii) He shall attend the Court as and when directed.
