JUDGMENT M. Jaichandren, J. 1. Heard the learned counsel appearing on behalf of the petitioner, as well as the learned counsel appearing on behalf of the 1st respondent-Bank. 2. At this stage of the hearing of the writ petition, the learned counsel appearing on behalf of the petitioner had submitted that, as per the directions issued by this Court, in its order, dated 29.11.2013, an amount of Rs.1,40,000/- had been paid to the 1st respondent-bank. The learned counsel appearing on behalf of the petitioner had further submitted that in view of the fact that the amount of Rs.1,40,000/- had been paid to the 1st respondent-bank, the 2nd respondent-Tribunal may be directed to take on file M.A.No.64 of 2013 and to decide the same, on merits and in accordance with law. 3. The learned counsel appearing on behalf of the 1st respondent-bank has no objection for this Court passing such an order. 4. In view of the above, the 2nd respondent-Tribunal is directed to take on file M.A.No.64 of 2013 and to decide the same, on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order. The auction sale, scheduled to be held, on 11.12.2013, shall be kept in abeyance, until final orders are passed by the 2nd respondent-Tribunal, in M.A.No.64 of 2013. Thereafter, it would be open to the 1st respondent-bank to proceed further against the petitioner, if it is found necessary, depending on the order to be passed by the 2nd respondent-Tribunal, in M.A.No.64 of 2013. The writ petition is disposed of accordingly. No costs. M.P.Nos.1 and 2 of 2013 are closed.
