body2013
JUDGMENT M. Jaichandren, J. 1. This Writ Petition has been filed challenging the impugned letter issued by the respondent-Bank, dated 30.9.2013, stating that the auction, in respect of the property in question, shall be held, on 30.10.2013. 2. At this stage of the hearing of the Writ Petition, the learned counsel appearing on behalf of the respondent-Bank had submitted that the impugned letter of the respondent-Bank, dated 30.9.2013, has no effect, at this stage, in view of the fact that a fresh auction notice had been issued, in respect of the property in question and the said auction is to be held, on 16.12.2013. 3. The learned counsel appearing on behalf of the petitioner had not refuted the said submissions made by the learned counsel appearing on behalf of the respondent-Bank. 4. In such circumstances, we find that the present Writ Petition has become infructuous and the same is dismissed accordingly. No costs. M.P.Nos.1 and 2 of 2013 are closed.
