JUDGMENT 1. Heard the Learned Counsel for the Petitioner as well as the Learned Special Government Pleader for R1 to R4. In spite of service of notice on the Respondents 5 to 7, there is no representation for the Respondents 5 to 7 either in person or through their counsel and the Respondents 5 to 7 are called absent. 2. The Petitioner has focused in the instant Writ of Mandamus praying for issuance of an order by this Court in directing the First Respondent/District Collector, Nagappattinam, to take action of his complaint, dated 05.11.2012. 3. The Petitioner in his representation/complaint, dated 05.11.2012, addressed to the First Respondent/District Collector, Nagappattinam District, as inter alia stated that with a view to grab his rightful shop, on 03.11.2012 at about 4.00 p.m., the Inspector along with the Sub Inspector, Kathirvel, has opened the shop and in view of the fact that the said shop which is under RDO enquiry has been opened and the same is being a violation of human rights on one side, there is no safety for his life and for his family and resultantly, as prayed for enquiry being conducted in this regard. 4. Per contra, it is the submission of the Learned Special Government Pleader for R1 to R4 that the complaint/representation of the petitioner, dated 05.11.2012, has been sent to the Second Respondent/Revenue Divisional Officer and the same is pending on the file of the Second Respondent. 5. In view of the fact that the Petitioner has addressed a letter/complaint, dated 05.11.2012, to the First Respondent/District Collector, Nagappattinam and although, the said complaint has been sent/transmitted to the Second Respondent/Revenue Divisional Officer, Mayiladudhurai, Nagappattinam District. Till date, the said Complaint has not been disposed of by the Second Respondent/Revenue Divisional Officer, Nagappattinam District. As such, this Court on the basis of Equity, Fair play, Good conscience and even as a matter of Prudence, directs the First Respondent to take necessary action in regard to the Complaint, dated 05.11.2012, submitted by the Petitioner, within a period of six weeks from the date of receipt of a copy of this order, in the manner known to Law and in accordance with Law. No costs.
