Judgment : This writ petition is filed by the petitioner to declare the action of the respondents in imposing the punishment withholding the annual increment for a period of two years without permanent effect by the 3rd respondent and which was modified into one year by the 1st respondent, as arbitrary and illegal by setting aside in so far the remaining punishment vide proceedings, dated 12-03-2012 of the 1st respondent and consequently direct the respondent not to effect the punishment imposed by the respondents. Heard both sides. The allegation against the petitioner is that he had removed the photo frames of God at controller point in Palakollu Bus station in an authoritative way and removed press letter boxes from the said bus stand complex. It is unfortunate that the disciplinary proceedings have been initiated against the petitioner for certain acts, which seems to have been done as part of his duty. Public servants have to work without fear and favour. Merely because some people became unhappy with the actions of the officers, the superior officers should not discourage the honest and sincere officers. The learned counsel for the petitioner submitted that the letter boxes were fixed without any authorization and without paying any rent. The petitioner has submitted a detailed explanation on 26-11-2010 giving reasons and according to him, the photos of God along with Hundi in a chair were causing obstruction to the movement of passengers. It is also his case that the news letter boxes were kept in a jig-jag manner with full of dust. A reading of the entire material gives an impression that the petitioner acted bonafidely in the public interest and the superior officers ought to have supported the action of the petitioner and protected him. Having regard to the facts and circumstances of the case, the Writ Petition is allowed at the admission stage setting aside the impugned proceedings, dated 12-03-2012. There shall be no order as to costs. The miscellaneous petition filed in this Writ Petition shall also stands closed.
