Judgment : Re: Application under Section 482 read with Section 401 of the Code of Criminal Procedure filed on 09.07.2013 Although, invoking Section 482 of the Code of Criminal Procedure, the petitioner sought for quashing of Complaint Case No. AC-2555/2010 under Sections 427/504 of the Indian Penal Code now pending before the learned 5th Judicial Magistrate, Alipore but at the very outset the learned counsel appearing for the petitioner submits that she is not pressing for the same. At the same time, I find from the grounds relied upon that in this case quashing has been sought for essentially on some disputed questions of fact, that truth or otherwise thereof cannot be adjudged at this stage without trial and therefore, I am also not inclined to consider the question of quashing. However, as has been prayed for by the learned Advocate for the petitioner and considering the fact that the case is pending for trial from 2010, I direct the learned Court below to conclude the trial as expeditiously as possible preferably within six months from the date of communication of this order. Office is directed to communicate this order to the Court below by special messenger at the cost of the petitioner to be deposited in course of tomorrow.
