JUDGMENT : The applicant, who was working as Assistant teacher in Badasankha Primary School under Laxmipur Block under the administrative control of District Inspector of Schools, Koraput Education Circle, Koraput in the district of Koraput had filed this O.A. in April 1996 with a prayer for a direction to the respondents to release/pay the applicant her salary and allowances at the rate which she was drawing during the period she had undergone C.T. training as in-service candidate. When this matter is taken up today, nobody appeared on behalf of the applicant nor the applicant herself remained present to move this O.A. Learned standing counsel (SME) is present. The records of the case indicates that the O.A. was filed on 27.4.1996 and it was admitted and notice was issued on 19.6.1996. Thereafter this case was never listed before this Tribunal. No steps have also been taken by the applicant for listing of this O.A. after 19.6.1996, even though in the meantime 17 years have passed. I have gone through the contents of the O.A. Briefly stated the applicant's case is that the applicant while working as Asst. teacher in Primary School, Badasankha was selected to undergo C.T. training at Govt. S.T. School, Bissam Cuttack vide order dated 14.1.1993. As such she had undergone training for the Sessions 1992-94. But the applicant was not given salary and other allowances during the said training period as was being given to her earlier excepting granting a stipend of Rs. 75/- per month. Hence, this case. Mr. Jee, learned standing counsel, on the basis of averments made in the counter, submits that it is a policy decision of the Govt. of Orissa to depute untrained in-service teachers to undergo training as their cases have been considered due to dearth of trained candidates. However, even if it is the duty of the candidates to get themselves trained at their own cost, the Govt. had sanctioned a stipend of Rs. 75/- per month for the training period. Hence, the relief as has been sought for by the applicant in this O.A. cannot be entertained.

Similar matters have already been disposed of by this Tribunal, wherein so far as the Teachers, who were engaged under the Rehabilitation Assistance Scheme without having C.T. qualification are concerned, it was observed that since the scheme under which they were engaged is a benevolent scheme, introduced by the State Authority to rehabilitate the family of their deceased employee and such benefit of compassionate appointment is extended in favour of one of the legal heirs of deceased employee with a specific purpose to save, the distressed family from their immediate need and in such cases one of the family members, even without having requisite training qualification were appointed, such candidates appointed as teachers, shall have to be sponsored for C.T. training at the cost of the State Government/respondent authorities, keeping in view the fact that unless the monthly salary is disbursed in their favour during their training period, the family shall have to face the same distress condition which they were facing after the demise of the concerned Government servant. So far as the teachers appointed facing regular selection process are concerned, since they would not have been eligible to be appointed as Primary School Teachers unless they have requisite training qualification, as such when such teachers shall undergo required training course, they shall have to complete such training course at their own cost and it can never be at the cost of the State. As such the principle/method relating to disbursement of salary during the training period which is being followed in the case of the teachers who are appointed under Rehabilitation Assistance Scheme without having training qualification, cannot be followed in the cases of regularly selected and appointed teachers, who were appointed without having requisite training qualification, in view of the discussion made above. In view of the above, the relief, as has been sought for by the applicant in this O.A. cannot be entertained. The O.A. is accordingly disposed of. O.A. disposed of.
