JUDGMENT Mr. Naresh Kumar Sanghi, J.:- Prayer in this petition is for grant of regular bail to petitioner-Amanpreet Singh @ Jeeta @ Jalandhari, who has been booked for having committed the offences punishable under Sections 279, 307, 337, 353, 473, 489 read with Section 34 of the Indian Penal Code and Section 25 of the Arms Act, in a case arising out of FIR No.46, dated 12.02.2010, registered at Police Station, Tripuri, District Patiala. 2. Learned counsel contends that the petitioner was arrested and granted regular bail by the learned trial court. He further submits that on account of noting down a wrong date, the petitioner could not appear before the learned trial court on 17.11.2012, therefore, his bail bonds were cancelled and nonbailable warrants were issued for securing his presence. He further submits that the petitioner remained absent for only one date. He further submits that now the petitioner is behind the bars from 09.01.2013 and the material witnesses of the prosecution have already been examined. 3. Learned counsel for the State though oppose the grant of bail to the petitioner but could not substantiate his submissions as to why further incarceration of the petitioner is justified. 4. Heard. 5. The petitioner was arrested and granted bail by the learned trial court. He could not appear before the learned trial court on 17.11.2012 and as a result of which, his bail bonds were cancelled and non-bailable warrants were issued for securing his presence. Now the petitioner is behind the bars from 09.01.2013. The material witnesses have already been examined. 6. Keeping in view the totality of the facts and circumstances of the case, the present petition is allowed. Petitioner- Amanpreet Singh @ Jeeta @ Jalandhari s/o Jatinder Singh, r/o House No.19, Prince Plaza Model Town, Jalandhar, is ordered to be released on bail during the pendency of the trial of this case subject to his furnishing bail bonds to the satisfaction of the learned trial court. 7. It is made clear that the learned trial court will be free to take action under Section 446, Cr.P.C in accordance with law. --------0.B.S.0------------
