Judgment : Learned advocate for the petitioner submits that recall of the sanctioning authority is necessary due to remissness on the part of the learned Public Prosecutor. Such prayer does not constitute filling up of laecuna inasmuch as there is no inherent wedge in the prosecution case. Let this matter appear under the same heading two weeks hence. Copy of the application be served through Registered Post with Acknowledgement Due and/or by personal service and to file affidavit of service on the next date of hearing. Let there be stay of the proceedings in Special (CBI) Case No. 80 of 2011 pending before the Learned Special Judge, CBI Court, Asansol, Burdwan arising out of RC 02(A)/2001/Kol dated January 31, 2001 for a period of four weeks from date. The petitioner is at liberty to pray for extension of this order upon notice to the opposite parties.
