JUDGMENT Mr. L.N. Mittal, J. (Oral):- Accused-Abid has filed this petition under Section 438 of the Code of Criminal Procedure (in short, Cr.P.C.) for anticipatory bail in case FIR No.416/2012 dated 23.12.2012 registered under Sections 323, 324, 452, 506, 326 and 34 IPC at Police Station Hathin, District Palwal. 2. I have heard learned counsel for the parties and perused the case file. 3. According to FIR, the petitioner was armed with Farsa but he allegedly inflicted stick blows. This discrepancy has not been explained either by the complainant or by injured persons. 4. Learned State counsel, on instructions from Head Constable Surinder Singh, stated that the petitioner caused a stick blow each on the right foot of Khalil-complainant and Jahid and also inflicted stick blow to Bhabal @ Gaffar whose seat of said injury is not clear but all the injuries of these three injured persons, attributed to the petitioner, are simple caused with blunt weapon. If the petitioner threw the Farsa he was carrying and picked up a stick from the spot and used the same to cause injuries as sought to be canvassed by learned State counsel although not so stated by any prosecution witness during investigation, this circumstances would also go in favour of the petitioner to the extent that he did not use the deadly weapon Farsa, which he was carrying. 5. Learned State counsel on instructions also stated that injury relating to offence under Section 326 IPC which was declared grievous was of Chaw Khan to whom no injury is alleged to have been caused by the petitioner. 6. Learned State counsel also stated that pursuant to interim order of this Court, the petitioner has since joined the investigation. It was, however, contended that weapon of offence i.e. Farsa or stick has not been got recovered by the petitioner. 7. Keeping in view all the circumstances, but without meaning to express anything on merits of the case, I find it to be a fit case to extend concession of anticipatory bail to the petitioner. Accordingly, the instant petition for anticipatory bail is allowed. Interim order dated 07.02.2013 is made absolute. --------0.B.S.0------------
