JUDGMENT Heard. 2. This appeal is directed against order dated 09.10.2012, passed by learned Judge, Family Court, Haridwar, in Misc. Case No. 61 of 2011, whereby said court has directed the husband (present appellant) to pay maintenance @ Rs. 10,000/- per month to his wife Anamika (present respondent) under Section 24 of Hindu Marriage Act, 1955. 3. Admittedly, the respondent is wife of the appellant. It is also admitted before the trial court that the 2 salary of the appellant (husband) is approximately Rs. 56,000/- per month. The trial court has directed Rs. 10,000/- per month to be paid to the wife (present respondent) under Section 24 of Hindu Marriage Act, 1955. Learned counsel for the appellant submitted that though the wife had earning capacity, she has purposely left the job, in which she was earning Rs. 8,000/- per month. 4. Having heard learned counsel for the appellant, and after going through the impugned order passed by the trial court, we do not find that any interference is required by this Court. 5. Therefore, the appeal is dismissed summarily, with the observation that the appellant Kishore Sharma may make application before the trial court for re-quantifying the amount of maintenance, in view of the subsequent order passed by Special Judicial Magistrate, Haridwar, under the Protection of Women from Domestic Violence Act, 2005, directing the husband (present appellant) to pay Rs. 6000/- per month under the said Act.
