JUDGMENT : Heard on the question of maintainability of this revision petition. 2. As per office report, this revision petition has been preferred from the jail against the judgment dated 01/02/13 passed by IV Additional Sessions Judge, Vidisha in Criminal Appeal No.80/12 affirming the judgment of conviction and the order of sentence dated 27/03/12 passed in Cr. Case No.486/05 by the Judicial Magistrate First Class, Vidisha whereby the accused, Jagdish Prasad Gupta has been convicted under Sections 7(1) read with 16(1)(A)(i) and 7(v) read with 16(1)(A)(ii) of Prevention of Food Adulteration Act and sentenced to suffer six months rigorous imprisonment with fine of Rs.1,000/and three months rigorous imprisonment with fine of Rs.500/respectively. 3. However, the accused/Jagdish Prasad Gupta through his counsel filed criminal revision against the impugned judgment bearing Cr. Revision No.115/13 (Jagdish Gupta Vs. Food Inspector through the office of Deputy Director, Food and Drug Department, District Vidisha). 4. Since, revision petition being Cr. Revision No.115/13 submitted by the petitioner/accused, Jagdish Gupta and pending before this Court, therefore, the subsequent revision received from the jail being not maintainable stands dismissed. Certified copy as per rules.
