Judgment :- Jayanta Kumar Biswas, J. The petitioner accused of offences under ss.302/120B/34 IPC and in custody from May 7, 2013 is seeking bail under s.439 CrPC. We have heard advocates for the petitioner and the state and have perused the case diary materials. We have closely examined the information given by the wife of the deceased (leading to registration of FIR), her s.161 statement, the post-mortem report, and the inquest report. The investigation is in progress. Two out of three accused are absconding. In view of the case revealed by the materials in the case diary, we do not think it will be appropriate to grant the petitioner bail at this stage. For these reasons, we dismiss the CRM.
