Judgment :- Jayanta Kumar Biswas, J. The petitioner accused of offences under ss.323/306/34 IPC and in custody from June 29, 2013 is seeking bail under s.439 CrPC. We have heard advocates for the petitioner and the state and have perused the case diary. The prosecution case is that the petitioner in love with the deceased girl refused to marry the girl and with his would be parents-in-law asked the girl to die; and that because of this behaviour the girl committed suicide taking poison. The investigation is in progress. The statement of a witness at p.14 supports the prosecution case. In our opinion, bail to the petitioner at this stage will not be appropriate. For these reasons, we dismiss the CRM.
