Judgment :- Jayanta Kumar Biswas, J: The petitioner accused of offences under ss.341/323/324/325/326/506/307/34 IPC and s.25 Arms Act and in custody from July 8, 2013 is seeking bail under s.439 CrPC. The court below has refused bail on July 8, 2013 referring to the gravity of the offences and stage of investigation. There are in all seven accused. Six have been granted anticipatory bail by this court. During pendency of the petitioner’s application for anticipatory bail he was arrested. Advocate for the petitioner has submitted that the petitioner stands on the same footing as the accused who have been granted anticipatory bail. Correctness of this has not been disputed by advocate for the state. He has further submitted that the principal accused has been granted anticipatory bail. We have examined the case diary materials including the injury report. Considering all aspects, we are of the view that it will be appropriate to grant the petitioner bail. For these reasons, we allow the CRM and direct that the petitioner shall be released on bail on a Rs.10,000 bond with two sureties (one local) of Rs. 5,000 each – all to the satisfaction of CJM, Nadia; and that if released, he shall report to the investigating officer, during investigation, once in a week.
