Judgment 1. The petitioner seeks for a direction to the respondents to appoint her for the post of Graduate Assistant in Physics in Government Higher Secondary School for the year 2009 – 2010. 2. The case of the petitioner is that she passed Bachelor Degree in B.Sc. Physics and also passed B. Ed Degree. She had registered her name in the District Employment Office at Madurai with periodical renewal. 3. During the academic year 2009 – 2010, the third respondent by way of notification dated 30.4.2010, called upon the petitioner to appear for certificate verification on 13.5.2010 for appointment to the post of Graduate Assistant in Physics. Accordingly, the certificates were verified on 13.5.2010. In the list published on 10.7.2010, the petitioner's name was shown as a provisionally selected candidate. However, in the list published on 27.07.2010, her name was deleted on the ground that B. Ed obtained by the petitioner was in the subject of Special Education. Therefore, the present petition is filed before this Court seeking for a Mandamus as stated supra. 4. The learned counsel appearing for the petitioner submits that the only ground on which the petitioner's selection was not made was that the petitioner was possessing B.Ed. Degree in Special Education. He further contended that such ground is no more available to the respondents in view of the order passed by the Government in G.O.Ms.No.56, Higher Education (K2) Department, dated 24.4.2012, whereby the Government after careful consideration have decided to accept the recommendation of the Equivalence Committee and accordingly, directed B. Ed.(Special Education) Course awarded by any University be considered as equal to B. Ed.(General Education) for the purpose of employment in Public Services. He also produced a copy of the G.O., before this Court. 5. The learned Additional Government Pleader appearing for the respondents fairly accepted the said submission of the learned counsel appearing for the petitioner and stated that the present G.O.Ms.No.56, Higher Education (K2) Department, dated 24.4.2012, protects the interest of the petitioner. 6. I have perused G.O.Ms.No.56, Higher Education (K2) Department, and dated 24.4.2012. The Government in the said G.O. directed that B. Ed (Special Education) Course is equivalent to B. Ed. (General Education) Course for the purpose of employment in Public Services. When the Government itself has already treated B. Ed. (Special Education) as equivalent to B. Ed. 6. I have perused G.O.Ms.No.56, Higher Education (K2) Department, and dated 24.4.2012. The Government in the said G.O. directed that B. Ed (Special Education) Course is equivalent to B. Ed. (General Education) Course for the purpose of employment in Public Services. When the Government itself has already treated B. Ed. (Special Education) as equivalent to B. Ed. (General Education) Course, there cannot be any impediment for the respondents in considering the claim of the petitioner for the appointment to the post of Graduate Assistant in Physics. 7. Accordingly, the respondents are directed to consider the claim of the petitioner for the appointment to the post of Graduate Assistant in any Government Higher Secondary School by taking note of G.O.Ms.No.56, Higher Education (K2) Department, dated 24.4.2012 and pass necessary orders thereon within a period of twelve weeks from the date of receipt of a copy of this order. 8. With the above direction, the Writ Petition is disposed of. The connected Miscellaneous Petition is closed. No costs.
