JUDGMENT SURINDER SINGH, J. 1. REPORT filed. Considered. 2. HEARD. The petitioner herein is an accused in FIR No.6 of 2013 dated 7.6.2013, registered in Police Station, SV & ACB, Shimla-2 for the offences punishable under Sections 420, 120B of the Indian Penal Code and Section 13(i) (d) read with Section 13(2) of the Prevention of Corruption Act, alongwith un-named public servants of Municipal Corporation, Shimla. The allegations against the accused persons including the petitioner have been that the SADA had ordered the demolition of unauthorized construction of the 6th storey of Whether reporters of the Local papers are allowed to see the judgment? the building in question. His appeal was also considered and rejected by the appellate authority, i.e., Principal Secretary, Town and Country Planning and thereafter CMPMO No.238 of 2005, which was also withdrawn. Thereafter the Officers/ officials of the Municipal Corporation approved the 6th storey alongwith slopping roof on 6.12.2012 by giving pecuniary benefit to the building owner, i.e., the petitioner. 3. NO recovery is to be effected from the petitioner herein. Some record is to be obtained from the Municipal Corporation as well as from the office of Town and Country Planning. 4. THE petitioner pursuant to the interim order is stated to have joined the investigation. Therefore, in view of above mentioned facts, the interim bail granted on 20.6.2013 is hereby affirmed on the same terms and conditions and in addition it is also directed that the petitioner shall keep on joining the investigation of this case as and when required and further he shall present himself in the Court whenever he is required to do so.
