JUDGMENT 1. - Heard learned counsel for the petitioner as well as learned Public Prosecutor. Perused the material placed on record. 2. The contention of the present petitioner is that he has implicated falsely. Prosecutrix Gunja has not supported the allegation of rape before the Court below. Hence, he should also be released on bail. 3. The learned Public Prosecutor opposed the bail application. 4. Having gone through the facts and circumstances of the case and without expressing anything on the merits of the case, I am inclined to grant bail under Section 438 (sic 439) Criminal Procedure Code 5. Accordingly, this bail application is allowed and it is directed that petitioner Mukesh S/o Shri Hura shall be released on bail on F.I.R. No. 59/2012, P.S. Patan, District Banswara Provided he furnishes a personal bond in the sum of Rs. 50,000/- along with two sureties of Rs. 25,000/- each to the satisfaction of the learned trial Court for his appearance before that Court on each and every date of hearing and whenever called upon to do so till the completion of the trial.Bail Application allowed. *******
