Judgment : A.M. Khanwilkar, J. - 1. This petition was filed in the backdrop of the unfortunate incident of stampede occurred at the shrine of Mata Naina Devi Mandir on 3rd August, 2008. Following reliefs have been claimed in the present petition: "(i) That the direction may kindly be issued to the respondents no.2 to 6 to provide the basic amenities like Civil Hospital, Police Post, Police assistance control room, fire brigades, toilets, well maintained metled roads, rain shelters, dharmshalas, fair price shops and potable water facilities in and around the shrine of Naina Devi Temple; (ii) That the respondents may also be directed to widen and keep the entire three roads in proper manner and made them viable in all weather times. (iii) That the respondents may be directed to provide adequate compensation of the bereaved families. (iv) That respondent no.7 may also be directed to provide and install loudspeakers, metal detectors and potable water tap at certain intervals in a 2-1/2 km. stretch of road which leads to Loin gate of Mata Devi Mandir." 2. The respondents contend that each of the facilities demanded by the petitioner is already provided in and around the Temple complex. According to them, nothing more is required to be done. Even then, if the petitioner were to point out any deficiency or make any suggestion regarding improving the facilities, those suggestions will be examined and necessary corrective measures will be taken. In any case, if the petitioner is of the opinion that in spite of giving sufficient time to the Trust Authorities and the State Authorities to rectify the mischief or to enhance the facilities already in place, necessary corrective measures are not taken by the concerned Authorities, it will be open to the petitioner to approach the Commissioner for issuance of appropriate direction to the Trust under Section 16 of the Himachal Pradesh Hindu Public Religious Institutions and Charitable Endowments Act, 1984. If such representation is made by the petitioner to the Commissioner, that must be decided by the Commissioner, after giving opportunity to all concerned, within eight weeks from its receipt and the decision, so taken, be communicated to the parties within the same time. 3. The petition is disposed of on the above terms, leaving all questions raised in the present petition open. Pending application(s), if any, also stands disposed of. Copy dasti.
