Judgment : A.M. Khanwilkar, J. – 1. The tender process in respect of publication dated 7th February, 2011, having already expired on 31st March, 2013, we are not inclined to examine the challenge to the said process having become academic. 2. The only reliefs that need to be considered are prayer clauses No. (iii) and (iv), which read thus: "(iii) That the respondent Department may be directed to include a technical person in the committee constituted for the purpose of approval of the sample items. (iv) That the respondent Department may further be directed to prepare the schedule rates for the supply of items required by the Government Offices so that there is no deviation in providing the items as per the specifications." Learned Advocate General submits that even these reliefs need not be considered in the present proceedings in view of the subsequent developments and, in particular, the decision of the Full Bench of this Court on the basis of which the department is formulating a comprehensive and selfcontained policy documents under Financial Rules, 2009, on the basis of which future tenders will be processed. 3. In the circumstances, even these petitions are disposed of on the same terms as in CWP No. 1935 of 2012D, so also the pending application(s), if any. Ordered accordingly.
