JUDGMENT Mr. Naresh Kumar Sanghi, J.:- Prayer in this petition is for grant of anticipatory bail to the petitioner, Parveen Kumar, who has been booked for having committed the offences punishable under Sections 120-B, 419 and 420, IPC, in a case arising out of FIR No.15, dated 08.03.2013, registered at Police Station, Kanwan, District Pathankot. 2. Learned counsel for the petitioner submits that the ase of the prosecution is that one Sunil Kumar was taking examination on behalf of the petitioner; that at best it would be a case for attracting the mischiefs of Sections 417 and 419, IPC which are bailable offences; that by no stretch of imagination, the ingredients of Section 420, IPC are attracted in this case and that the main accused, Sunil Kumar, has already been arrested and granted bail. He further submits that in compliance of the order dated 10.04.2013 passed by this Court, the petitioner did join the investigation and no more required by the police for any other purpose. 3. Learned counsel for the State, on instructions from ASI Gurinder Pal Singh, Police Station, Kanwan, District Pathankot, very fairly concedes that in compliance of the order dated 10.04.2013 passed by this Court, the petitioner had appeared before the Investigating Agency and joined the investigation, therefore, he is no more required by the police for any other purpose. 4. Keeping in view the totality of the facts and circumstances of the case, the present petition is allowed and the order dated 10.04.2013 whereby the ad-interim anticipatory bail was granted to the petitioner, is made absolute. 5. The petitioner shall continue to join the investigation as and when required to do so and abide by all the conditions laid down under Section 438(2), Cr.P.C. ---------0.B.S.0------------
