JUDGEMENT A .M.KHANWILKAR, J. - 1. HEARD counsel for the parties. 2. THE eligibility criteria provided in the prospectus at page 26 reads thus: "Eligibility Criteria B. Tech (i) The candidate should have passed 10+2 (Class XII) examination or its equivalent from a recognized board/university with Physics and Mathematics as compulsory subjects along with any one of the optional subjects: (a) Chemistry (b) Biology (c) Computer Science (d) Bio-Technology. (ii) Admission in the first instance will be made on the merit of rank/marks obtained in AIEEE-2013. (iii) In case the seats remain vacant after exhausting AIEEE merit of rank/marks, the remaining vacant seats will be filled up on the merit of qualifying examination i.e. 10+2. (iv) Lateral entry seats for admission to 2nd year B. Tech. will be filled on the basis of merit of 3-yr . Diploma/B.Sc. degree in the concerned branch from a recognized board." The communication issued by the Special Secretary (TE) to the Government of Himachal Pradesh dated 25th July, 2013, reads thus: "No. EDN (TE) A (9)1/2012 Government of Himachal Pradesh Department of Technical Education. From The Pr. Secretary (Technical Education) to the Government of Himachal Pradesh, Shimla-2. To The Registrar, HP Technical University, Hamirpur, HP. Dated Shimla-2 the 25th July, 2013. Sub: Regarding Joint Entrance Examination (JEE) 2013. Sir, I am directed to refer to this department's letter of even number dated 16.11.2012 addressed to GOI, MHRD and a copy thereof endorsed to you on the subject cited above and to convey one time permission to make admission to B.Tech Courses only for the academic session 2013-14 in all the Private Universities and Engineering Institutions in the State on the basis of qualifying examination i.e. Physics, Mathematics and one of the subject from (Chemistry, Bio-Technology, Computer Science, Biology) along with 65% marks in total including all the above subjects after exhausting the merit of JEE (Main) 2013. You are therefore requested to intimate all the concerned accordingly. Yours faithfully, Sd/- Special Secretary (TE) to the Government of Himachal Pradesh." 3. INDEED , the applications preferred by the petitioners will have to be processed keeping in mind the eligibility criteria read with the communication issued by the Special Secretary (TE), Government of Himachal Pradesh. The respondents assure to do so. In view of this assurance, the . petitioners do not wish to pursue this petition any further.
