JUDGMENT 1. This Petition is filed for modification of the order passed by the learned Principal Sessions Judge, Chennai dated 31.10.2012 in Crl. M.P. No. 11006 of 2012 in CA. No. 206 of 2012 on the ground that the petitioner is unable to comply with the condition regarding the payment of fine. 2. It is seen that the court below has passed order on 31.10.2012. Even though the order has been passed on 31.10.2012, the petitioner is not able to get the benefit of the same, as he is unable to comply with the condition. 3. Considering the scope of Article 21 of the Constitution of India and taking note of the facts, this Court is of the view that when the person, who is convicted is unable to comply with the condition imposed by a court of law which otherwise granted the suspension order, then the said condition, will have to be modified suitably. 4. In such view of the matter the condition imposed regarding payment of rupees of Rs.1,00,000/- is modified to Rs. 25,000/- and rest of the conditions imposed on the petitioner shall remain unaltered. A period of two weeks time is hereby granted to comply with the said condition from the date on which the order copy is made ready.
