body2013
ORDER : The High Court has declined anticipatory bail to the petitioners in a case registered against him for offences punishable under Sections 406, 409, 468, 420 and 34 of the Indian Penal Code. Our attention has been drawn to an order dated 19.10.2012 passed by us in Criminal Appeal No. 1704 of 2012 by which we had enlarged the co- accused on bail on his furnishing bail bonds in a sum of Rs. 20,000/- with two sureties in the like amount to the satisfaction of the trial court. Mr. Anip Sachthey, learned counsel for the respondent- State submits that the charge sheet against the petitioners having already been presented before the competent court, the petitioners can as well approach the trial court for grant of regular bail. We see merit in that submission. We accordingly direct the petitioners to approach the trial court for grant of regular bail within a period of two weeks from today. For a period of two weeks the petitioners shall remain protected against arrest. The trial court shall while considering the prayer for regular bail remain uninfluenced by the fact that we had granted interim protection to the petitioners. 2. The special leave petition is disposed of with the above observations. SLP disposed of.
