ORAL JUDGMENT The Petitioners seek quashing of the entire proceeding including the order of cognizance dated 19.7.2001 passed by the Judicial Magistrate, 1st class, Patna city in C.A. No.148 of 2001. 2. The case of the Complainant is that he and the accused persons agreed to purchase and sell two kathas of land in Patna, on which an unregistered deed of agreement for sale was prepared. Both the parties signed on the same and a consideration amount was also paid by the Complainant to the accused persons. Subsequently some more money was paid but later on it was found out that the title of the land did not belong to the accused persons. It was under these circumstances that the Complainant sought prosecution of the Petitioners. 3. It has been submitted on behalf of the Petitioners that the Petitioner No.1 has also filed Complaint case No.663 of 2000 upon which Malsalami P.S. case No.163 of 2000 was instituted against the Informant, her husband and others. In the said case he has given a different picture. It also appears that for setting aside the sale deed one Title Suit has been filed and a Money Suit has been filed for recovery of advance amount. The Petitioners submit that under the circumstances of the civil proceedings pending, the present criminal case should not be permitted to proceed as a supplementary proceeding. 4. On the other hand, the Counsel for the Informant submits that he is also being prosecuted in another case as mentioned by the Petitioners and, therefore, care should be taken to protect his interest as well. Considering that the parties should sort out their differences in the Civil Suit, I am inclined to allow this application. 6. In the result, the application is allowed and the entire proceeding including the order dated 19.7.2001 passed by the Judicial Magistrate, 1st class, Patna city in C.A. No.148 of 2001 is hereby quashed. 7. However, the quashment of the present proceeding shall have no bearing on any civil litigation pending between the parties.
