JUDGMENT Anand Byrareddy, J.—There is a delay of 55 days in filing the appeal. The delay for reasons stated, is condoned. The learned Counsel for the respondents vehemently objects as to the maintainability of the appeal and points out that the appellant is the purchaser of land which was acquired by the Bangalore Development Authority and the purchase admittedly was made after the land was notified under the provisions of the Bangalore Development Authority Act, 1976 (hereinafter referred to as 'the BDA Act', for brevity). 2. The learned Counsel for the appellant would not seriously dispute this factual situation, while he would contend that even if the appeal is to be rejected at the threshold on this ground, the other remedies available to the petitioner ought not to be prejudiced by virtue of the dismissal. Therefore, the petitioner is left to his remedies elsewhere. Accordingly, the appeal is rejected. If there are legal remedies available to the petitioner, he may pursue the same, in due course.
