JUDGMENT : Surinder Singh, J. Notice. Mr. J.S. Rana, learned Assistant Advocate General waives service of notice on behalf of respondent No.1. Mr. Vivek Negi, learned counsel waives service of notice on behalf of respondents No.2 and 3. 2. The petitioner feels aggrieved by the order of learned Additional District Judge, Shimla, whereby his reference petition was dismissed on a short ground that it was not made in consonance with Section 18 of the Land Acquisition Act to the Land Acquisition, Collector. Since no reference was received in the Court from the Land Acquisition Collector, as such, the learned Additional District Judge has no power to deal with the matter. 3. By means of present writ petition, petitioner seeks the writ of certiorari for setting aside impugned order dated 15.9.2012 (Annexure P-3) and issuing mandamus for the restoration of Land Reference to its original number and position, with a direction to the learned Court to proceed with the land reference. Learned counsel for the petitioner has brought our attention to notice dated 18.12.2007 (Annexure P-1), whereby the Collector, Land Acquisition, HPSEB, Shimla has sent the present petition alongwith 19 others for determination to the learned District Judge concerned. 4. Mr. Vivek Negi, learned counsel for respondent No.2, under instructions from respondent No.2 also states at the Bar that Objection Petition of Chatter Singh, petitioner herein, was also sent to learned District Judge by making a reference in accordance with Section 18 of the Act aforesaid. 5. In view of the above stated position, learned Assistant Advocate General has no objection in allowing the present petition. As such, we hereby set aside order dated 15.9.2012 (Annexure P-3), passed by the learned Additional District Judge, Shimla and direct to restore the Land Reference No.55-R/14 of 2008 to its original number and position and proceed with the matter in accordance with law. 6. The parties are directed to be present before the learned Additional District Judge, Shimla on 25.9.2013. 7. With the aforesaid observations, present petition stands disposed of, so also the pending applications(s), if any.
