JUDGMENT P.V.Hardas, J.: 1. Both these applications have been filed by the applicants in the same crime seeking quashing of the first information report, registered against them under Sections 306 r/w 34 of the Indian Penal Code and under Section 32 (b) of the Bombay Money Lenders Act. Both these applications are, therefore, decided by this common judgment. 2. Hence, the applications are admitted and heard forthwith. 3. Deceased Janardhan Shinde committed suicide as he could not meet his liability of repayment of loan advanced by the applicants and other accused. Accordingly, an offence punishable under Sections 306 r/w 34 of the Indian Penal Code and under Section 32 (b) of the Bombay Money Lenders Act was registered against the applicants. 4. It further appears that one of the accused namely Tushar Mahadeorao Arsul had filed Criminal Application No. 3683 of 2012 which was allowed by the Division Bench of this Court by judgment, dated 26.11.2012. The Division Bench quashed and set aside the first information report and the consequent registration of the offence on the ground that the contents of the first information report, even if accepted as true, do not prima facie, disclose the commission of the offence. 5. The allegations against the present applicants are similar to the allegations made against the accused Tushar who had filed Criminal Application No. 3683 of 2012. 6. For the reasons given in the judgment, dated 26.11.2012 in Criminal Application No. 3683 of 2012, the present applications are allowed and the first information report against the present applicants is quashed.
